An NGT bench on Friday imposed an interim penalty on contractors Danish Yusuf and Rauf Ahmed for violating the terms and conditions of environmental clearance for mining leases in their favour.

Allowing the petition in part, the bench imposed an interim environmental compensation of Rs 7,46,400 on Danish Yusuf and Rs 8,33,520 on Rauf Ahmed.

The contractors have been directed to submit it to the Jammu and Kashmir Pollution Control Board within two months.

“The said amount will be subject to final calculation of environmental compensation by JKPCC,” it said.

The bench said that it could not determine the environmental compensation in the absence of the requisite information about the quantity of minerals extracted by the respondents, the selling price of the minerals and the actual duration of the mining activities.

“We find it appropriate to direct the JKPCC to proceed with computation of environmental compensation as per law, besides other prohibitive and punitive action against respondents 5 and 6 and remedial measures for rehabilitation and restoration of environmental damage. investigation”.

The environmental compensation amount will be used for restoration, rehabilitation and environment restoration in the affected area which will be developed jointly by JKPCC and Collector Budgam.CNI
