I wish to draw your kind attention towards a long-standing and deeply distressing issue concerning the residential houses and landed properties of displaced Kashmiri Pandits across the Kashmir Valley under security forces and other administrative agencies.
Over the past several decades, a considerable number of these properties have remained under occupation, largely by security forces or other administrative agencies. These properties are not ordinary plots—they are centrally located, well-maintained, and situated in prime, commercially valuable areas of the Valley. Despite their enormous current market value, the rent being paid for their occupation remains shockingly low, outdated, and entirely disproportionate to the worth of the land and houses.
Sir, this situation has caused not only severe financial injustice to the rightful owners but also emotional anguish. It is unacceptable that such prime real estate, some of it worth crores today, continues to be used on rent rates fixed decades ago, with no link to present market conditions, inflation, or property appreciation. The owners—displaced and already struggling—are given meagre compensation that does not even meet basic rental norms, let alone reflect the real value of the occupied assets.
Sir, we strongly urge your esteemed office to initiate a fair and time-bound reassessment of all occupied properties and ensure that rentals are revised in accordance with current market values. Furthermore, all pending rent dues from past years must be paid to the rightful owners at the enhanced and updated rates.
Sir, it is equally important to ensure that these houses and lands are not subjected to any damage, structural alteration, or encroachment during the period of occupation. Numerous reports have emerged of unauthorized construction, destruction of trees, tampering with boundaries, and expansion of buildings—often without any written consent from the legal owners. This not only causes long-term damage to private assets but also violates the fundamental rights of ownership. We request that immediate directions be issued to prevent any further alteration, expansion, or construction on such occupied properties unless there is explicit, documented permission from the concerned owners.
Sir, moreover, it must be ensured that whenever a property owner wishes to reclaim possession of their land or house, the same is vacated without unnecessary delays, resistance, or procedural hurdles. The process of vacation should be smooth, timely, and respectful of the legitimate ownership rights of the displaced individuals or families.
Sir, these ancestral homes and lands are not abandoned assets but emotional legacies passed down through generations. Their continued exploitation or misuse is not only legally and morally wrong but also adds to the deep emotional trauma that the displaced Kashmiri Pandit community has silently endured for over three decades.
Sir, we, therefore, request your personal intervention and immediate direction to the concerned authorities for appropriate and just action in this matter.
A copy of this communication is also being sent to the Divisional Commissioner, Kashmir, for necessary implementation and follow-up please.
