ICJ Orders Israel To Stop Rafah Military Offensive

New Delhi, (CNI MONITERING )The International Court of Justice (ICJ) has ordered Israel to halt its Rafah military offensive and asked it to open its Rafah crossing for aid.

 

The order was read out by Nawaf Salam, the head of the ICJ.

 

In its order, the court emphasised that the catastrophic humanitarian situation in the Gaza Strip which, as stated in its order of January 26, 2024, was at serious risk of deteriorating, has deteriorated. It has done so even further since the ICJ adopted its order of March 28, it noted.

 

The court said that 13 judges ordered the provisional measures indicated in the court’s orders of January 26 and March 28 “be immediately and effectively implemented.” Two judges voted against this.

 

It said that Israel should immediately halt its military offensive in Rafah and open the Rafah crossing for unhindered provision at scale of urgently needed basic services and humanitarian assistance.

 

“The State of Israel shall, in conformity with its obligations under the Convention on the Prevention and Punishment of the Crime of Genocide, and in view of the worsening conditions of life faced by civilians in the Rafah Governorate…immediately halt its military offensive, and any other action in the Rafah Governorate, which may inflict on the Palestinian group in Gaza conditions of life that could bring about its physical destruction in whole or in part.”

 

It also ordered that Israel has to take measures of unimpeded access to the Gaza Strip for any commission of inquiry, fact-finding mission or other investigative body mandated by competent organs of the United Nations to probe allegations of genocide.

 

The court said: Take effective measures to ensure the unimpeded access to the Gaza Strip of any commission of inquiry, fact-finding mission or other investigative body mandated by competent organs of the United Nations to investigate allegations of genocide.

 

The court decided that Israel shall submit a report to give effect to this order within one month.

 

In all these orders, 13 judges voted for and two, against. President Nawaf Salam and Judges Abraham, Yusuf, Xue, Bhandari, Iwasawa, Nolte, Charlesworth, Brant, Gómez Robledo, Cleveland, Aurescu, and Tladi voted for the notions. Vice-President Sebutinde and Judge ad hoc Barak dissented.

 

The ICJ is delivering these orders on the request for the indication and modification of provisional measures submitted by South Africa on May 10, in the case concerning Application of the Convention on the Prevention and Punishment of the Crime of Genocide in the Gaza Strip.( CNI MONITERING)
