Request for Renewal of Murder, Massacre, and Target Killings Cases of Kashmiri Pandits under New Criminal Laws

Jammu : Kashmiri Pandit Conference (KPC),a representative organisation of Kashmiri Pandit community wanted to invite your kind attention towards a matter of utmost importance that concerns the long-standing quest for justice by the victim Kashmiri Pandit community.

 

Sir we, at the Kashmiri Pandit Conference,( KPC ) warmly welcome the recent enactment of three new criminal laws under the Bharatiya Nayaye Sanhite (BNS) and others in India. These new laws represent a significant step forward in addressing historical injustices faced by our community, particularly concerning murders, massacres, target killings, buring of houses, loot and arson ,both pre and post forced displacement of Kashmiri Pandits from the Kashmir Valley.

 

Sir, over the past decades, our community has endured unimaginable suffering, including targeted killings of our youth, employees and prominent members, as well as numerous massacres such as those at Wandhama, Ganderbal, Nadimarg, Shopian, and other places. Regrettably, under the previous legal framework, many of these cases were either neglected or subjected to undue delays, leaving the victims’ families in a state of prolonged uncertainty and injustice.

 

Sir, with the implementation of the new criminal laws across the country, including in Jammu and Kashmir, we now see a ray of hope for expeditious justice. These laws provide an opportunity to revisit and expedite the investigation and prosecution of pending cases related to the atrocities committed against Kashmiri Pandits. It is our firm belief that the enactment of these laws signifies a renewed commitment to ensuring justice for all, particularly for marginalized communities like victim KashmiriPandits.

 

Sir, therefore, we earnestly appeal to the authorities in the Union Territory of Jammu and Kashmir to take proactive measures in renewing and prioritizing the investigation of all pending FIRs pertaining to murders, massacres, and targeted killings of Kashmiri Pandits. This includes incidents both before and after our forced migration, where justice has been long overdue.

 

Sir, we emphasize the urgent need for a comprehensive and thorough re-examination of these cases under the purview of the new legal provisions. The victims’ families have been waiting for justice for over three decades, and it is imperative that their voices are heard and their grievances addressed promptly.

As representatives of the Kashmiri Pandit community, we are committed to supporting and cooperating with the law enforcement agencies in every possible manner to ensure that justice is not only served but also seen to be served.

 

Sir, we trust that our plea will receive your utmost attention and that necessary steps will be taken swiftly to initiate fresh investigations and proceedings where warranted by the new legal framework. This proactive approach will not only uphold the principles of justice but also restore faith in the judicial system among the affected families.
